Article 1 – Definitions

For the purposes of these Terms and Conditions, the following definitions apply:

  • Cooling-off period: The period during which the consumer may exercise the right of withdrawal.

  • Consumer: A natural person not acting in a professional or commercial capacity who concludes a distance contract with the trader.

  • Day: A calendar day.

  • Distance selling: A distance contract relating to one or more products and/or services where the obligation to supply and/or purchase extends over a period of time.

  • Durable medium: Any instrument which enables the consumer or trader to store information personally addressed to them in a way that allows future reference and reproduction in unchanged form.

  • Right of withdrawal: The possibility for the consumer to withdraw from a distance contract within the withdrawal period.

  • Trader: Any natural or legal person who offers goods and/or services to consumers by means of distance selling.

  • Distance contract: A contract concluded exclusively by one or more means of distance communication within a system organized by the trader for the distance selling of goods and/or services.

  • Means of distance communication: Any means that can be used to conclude a contract without the consumer and trader being physically present in the same place at the same time.

  • General terms and conditions: These general contractual conditions applicable to the trader.

Article 3 – Applicability

  1. These general terms and conditions apply to all offers made by the trader and to all distance contracts and orders concluded between the trader and the consumer.

  2. Before a distance contract is concluded, these terms and conditions will be made available to the consumer. If this is not reasonably possible, the trader will inform the consumer where the terms and conditions can be reviewed and that they will be sent free of charge upon request.

  3. Where the distance contract is concluded electronically, the terms and conditions shall be provided to the consumer in such a way that they can be easily stored on a durable medium.

  4. If specific product or service terms apply in addition to these general terms, both shall apply, but the consumer may rely on the most favorable provision.

  5. If any provision of these terms is declared invalid, the remaining provisions will continue to apply.

  6. Any situations not covered by these terms or ambiguities regarding interpretation shall be resolved in the spirit of these terms and conditions.

Article 4 – Offer

  1. If an offer is of limited duration or subject to conditions, this will be clearly stated.

  2. The trader reserves the right to modify or adjust the offer at any time.

  3. The offer will include a complete and accurate description of the products and/or services offered, with sufficient detail for proper assessment by the consumer.

  4. Images used by the trader shall truthfully represent the products offered, though color variations may occur due to screen differences.

  5. Obvious errors or mistakes in the offer are not binding on the trader.

  6. All illustrations, specifications, and information are indicative and cannot give rise to claims for damages or contract termination.

Each offer shall clearly state:

  • The total price excluding customs duties and import VAT (these costs are borne by the customer).

  • Shipping and transport costs.

  • The method of contract conclusion and the steps necessary to do so.

  • Whether the right of withdrawal applies.

  • Accepted payment methods and delivery process.

  • The period during which the offer remains valid.

  • Any applicable communication charges.

  • How the contract is stored and how the consumer may access it.

  • Languages in which the contract can be concluded.

  • Applicable codes of conduct and how to access them electronically.

  • The minimum contract duration (if applicable).

  • Product options such as sizes, colors, and materials.

Article 5 – Contract

  1. The contract is concluded when the consumer accepts the offer and fulfills its conditions.

  2. If the consumer accepts the offer electronically, the trader will promptly confirm receipt of acceptance. Until confirmation is received, the consumer may cancel the contract.

  3. The trader will take appropriate technical and organizational measures to ensure secure data transmission and online payment.

  4. The trader may, within legal limits, verify the consumer’s ability to meet payment obligations. Based on this information, the trader may refuse an order or impose special conditions.

  5. The trader will provide the consumer with the following information in writing (or via durable medium):

    • The trader’s physical business address for complaints.

    • Instructions on exercising the right of withdrawal, or an indication if withdrawal is excluded.

    • Information about warranties and after-sales service.

    • The information required under Article 4, unless already provided.

    • Termination conditions for long-term or indefinite contracts.

  6. All contracts are subject to product availability.

Article 6 – Right of Withdrawal

  1. Consumers may withdraw from the contract within 14 days of receiving the product, without giving any reason.

  2. During the withdrawal period, the consumer must handle the product and packaging carefully and only inspect it as necessary to determine whether to keep it.

  3. To exercise this right, the consumer must notify the trader within 14 days of receipt, in writing or by email.

  4. The consumer must return the goods within 14 days of notification and provide proof of timely return (e.g., postal receipt).

  5. Failure to notify or return the product within the stated periods will render the transaction final.

Article 7 – Costs of Withdrawal

  1. If the right of withdrawal is exercised, the consumer bears all return shipping costs.

  2. If the consumer has made any payments, the trader will refund these within 14 days of receiving the returned goods or proof of shipment.

Article 8 – Exceptions to the Right of Withdrawal

The trader may exclude the right of withdrawal for certain products, provided this is clearly stated in the offer or before conclusion of the contract.

Exclusions apply to:

  • Goods made to the consumer’s specifications or clearly personalized.

  • Goods that cannot be returned for hygienic or health reasons and where the seal has been broken.

  • Goods that deteriorate or expire rapidly.

  • Goods subject to financial market fluctuations beyond the trader’s control.

  • Newspapers, magazines, and periodicals.

  • Audio, video, or software products where the seal has been broken.

  • Hygiene-related items where the seal has been broken.

Exclusions may also apply to:

  • Services for accommodation, transport, catering, or leisure activities performed on a specific date or within a specific period.

  • Services that have begun with the consumer’s express consent before the withdrawal period ends.

  • Games and lotteries.

Article 9 – Price

  1. Prices are subject to market fluctuations beyond the trader’s control; any variable pricing will be clearly indicated.

  2. Price increases within three months of contract conclusion are only permitted if required by law or regulation.

  3. If a price increase occurs, the consumer has the right to terminate the contract as of the date it takes effect.

  4. Deliveries originate outside the EU, meaning import VAT and customs fees are charged by the postal or courier company to the customer.

  5. The trader is not liable for typographical or printing errors and is not obliged to honor erroneous prices.

Article 10 – Conformity and Warranty

  1. The trader guarantees that products comply with the contract, offer specifications, and applicable legal requirements.

  2. Any defects must be reported in writing within 14 days of delivery. Items must be returned in their original packaging and new condition.

  3. The warranty period matches that of the manufacturer.

  4. The guarantee does not cover defects arising from:

    • Unauthorized repairs or modifications by the consumer or third parties.

    • Improper or negligent use contrary to instructions.

    • Governmental regulations affecting materials or quality standards.

Article 11 – Delivery and Performance

  1. The trader exercises the utmost care when receiving and fulfilling orders.

  2. Deliveries originate from outside the EU; thus, import VAT and customs clearance fees are charged to the customer by the courier.

  3. Orders are fulfilled promptly, within 30 days unless a longer period is agreed.

  4. If delivery is delayed, the trader will notify the consumer within 30 days, who may then cancel the order and receive a refund within 14 days.

  5. If a product is unavailable, a replacement may be offered. If a replacement is provided, it will be clearly stated, and the consumer retains the right of withdrawal.

  6. The risk of loss or damage remains with the trader until delivery to the consumer or an authorized representative.

Article 12 – Duration, Termination, and Renewal

  1. The consumer may terminate an indefinite contract for regular delivery of goods or services with one month’s notice.

  2. Fixed-term contracts may be terminated at the end of their period with one month’s notice.

  3. Contracts may not be renewed automatically unless permitted by law, and only with clear consumer consent.

  4. Test or trial subscriptions terminate automatically at the end of the trial period.

  5. For contracts exceeding one year, the consumer may terminate after one year with one month’s notice, unless fairness dictates otherwise.

Article 13 – Payment

  1. Unless otherwise agreed, payments must be made within 7 working days from the start of the cooling-off period.

  2. The consumer must immediately notify the trader of any payment errors.

  3. If payment is not made on time, the trader may charge reasonable collection costs, provided these have been communicated in advance.

Article 14 – Complaints

  1. Complaints must be clearly described and submitted within 7 days after discovery of the issue.

  2. The trader will respond within 14 days of receipt. If more time is needed, the trader will provide an estimated response time.

  3. If the complaint cannot be resolved mutually, a dispute will be deemed to exist.

  4. The complaint does not suspend the trader’s obligations unless otherwise stated in writing.

  5. If a complaint is found to be justified, the trader will repair or replace the product free of charge.

Article 15 – Disputes

These Terms and all agreements between the trader and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
